HMRC Penalty Advice / Help

With HM Revenue & Customs having to find even more money for the exchequer it is little wonder that they have been issuing more penalties than ever before. In the last 7 months we at Tax Champion have seen a steady rise in penalties for late returns, penalties for late payments and, of course, penalties on tax and class 4 NIC due from enquiries.

The purpose of an HMRC tax enquiry is to find any additional tax which was missing from the original return. If the taxman finds that additional tax is due then you may face a "tax-geared" penalty: of up to 100% of the extra tax - or even 200% if the evaded tax is linked to an offshore bank account.

Penalties on the additional tax due will be charged at varying percentages depending on their findings during the enquiry. If they believe an error occurred as a result of "careless" or negligent behaviour where there has been good co-operation will carry a lower penalty than “deliberate” behaviour with no co-operation. Voluntary disclosures get lower penalties. 

Tax Offenders register

HM Revenue & Customs have developed the Tax Offenders register which will remain public for a year and HMRC will actively encourage local papers to print stories. Taxpayers who have duties over £25,000 which resulted from deliberate or fraudulent behaviour will be included on this list which shows taxpayers name address and his offence. They also have a programme called “Managing Deliberate Defaulters" programme. Anyone caught fiddling their tax could be put on this programme and would face intrusive follow up scrutiny for the next 5 years, after the initial tax investigation has ended.

The sooner you involve Tax Champion in your enquiry the more penalty advice we can give. Remember that the way in which you handle the enquiry will determine the penalty at the end. 

If you receive a late payment letter for PAYE make sure you pay all other months on time, as you won’t get a further reminder, each month will be noted as being late and next tax year you will be issued with penalties. If you are a day late for four months you will be charged 3% of the late PAYE as a penalty.
