Counting the cost

In the First Tier Tribunal Hearing Yetis [2012] TC 02410, Mr Yetis appealed against the assessments issued by HMRC. The judge ruled that the only issue in this appeal is whether, during the relevant period, Mr Yetis was an employee of Style.

Unfortunately, the burden was on Mr Yetis to satisfy the tribunal judge that he was an employee. This comes from the tax case Brady (HMIT) v Group Lotus Car Companies plc [1987] BTC 480 in which Mustill LJ stated at p 487:

The starting point is an ordinary appeal before the Tribunal. Here, however unacceptable the idea may be to the ordinary member of the public, it has been clear law binding on this court for sixty years that an inspector of taxes has only to raise an assessment to impose on the taxpayer the burden of proving that it is wrong: T Haythornthwaite & Sons, Ltd v Kelly (HMIT) (1927) 11 TC 657

This is the case for all taxpayers where HMRC raise assessments based on assumptions. It can take months to sort out at a huge cost, especially if the taxpayer has to take his case to tribunal.
